TERMS AND CONDITIONS
BORROW THAT BAG LIMITED

For the purpose of these Terms and Conditions, and our website, the following terms relate to BORROW THAT BAG LIMITED: BORROW THAT BAG, GET THAT BAG, BTB AND GTB "we", "the company", "the service", "us", "our", "www.borrowthatbag.co.uk", "www.getthatbag.co.uk", "the site" and "the website".
BORROW THAT BAG is a designer handbag rental website, offering the opportunity to acquire bags, jewellery and gifts when available.

Membership
Applicants for Registered Membership are making an offer to join BORROW THAT BAG which may be accepted or rejected at the company's discretion. The offer is made via the Membership page and all details added must be true, current and correct.
Members must be resident in the UK.
Members must be aged 18 or over.
Members must have a valid method of payment (Credit or debit card).
Membership is for one person's use only unless expressly agreed by BORROW THAT BAG.
Membership is free.
By hiring a bag from BORROW THAT BAG, members agree to look after the bag and return it on time and in the same good condition. During the hire period the responsibility for the bag lies solely with the Registered Member.
Members may not sell, rehire or modify bags belonging to BORROW THAT BAG.

Upon signing up with the site, all member obligations detailed within these Terms and Conditions will apply to said member.
Upon hiring their first bag, the member will undertake the company's security checks before their first bag is despatched. In the first instance bags will only be dispatched to the address under which the members payment method is registered. The company will often run credit checks as part of its security checks. BORROW THAT BAG reserves the right to pre-authorise a minimum charge equal to the replacement value of the hired bag as part of its security checks.

Payment
By joining BORROW THAT BAG , members agree to pay the relevant weekly (or fortnightly or monthly) fee for the bag they select, and £9.95 for delivery, return is by FREEPOST.
By joining BORROW THAT BAG and using the service, members authorise the company to process charges on their payment card, in the instances of rental payments including delivery and damage/theft/loss payments (see Damage/Theft/Loss section for full details). Members also authorise BORROW THAT BAG to take an authorization of the members card details which allows us to confirm there is sufficient credit available in the member's account to cover loss or damage to the bag if that were to occur whilst the bag is hired to the member. Such authorization does not take any money from the member's account but ensures a sum of money is available in the account.
Authorisation to take payments will continue until the member or BORROW THAT BAG terminate or suspend the membership.
BORROW THAT BAG will not divulge member's payment details to third parties.
BORROW THAT BAG reserves the right to terminate or suspend membership for failure to use the service in a proper manner, non-payment of fees or a breach of these Terms and Conditions. In such instances, the company will take necessary measures to reclaim any property oustanding, eg, handbags due for return, and the member will be liable for any expense incurred during this process.
Similarly, should BORROW THAT BAG incur any costs for late payments or late returns of bags hired, the company reserves the right to pass these expenses on to the member for payment.
Where taxes are included in all BORROW THAT BAG prices and fees; members agree to pay these taxes as their responsibility.
Members are solely liable for any charges incurred on their own financial account by their own act or omission. Members should notify BORROW THAT BAG of any problems regarding processing of payments.

Authenticity and Provision of Bags
All bags provided by BORROW THAT BAG are guaranteed authentic designer bags and are provided in new or as-new condition. Proof of authenticity and receipts are available for inspection upon request.
All bags remain the exclusive property of BORROW THAT BAG at all times.

Damage/Theft/Loss
Should the bags become damaged, lost or stolen, the member agrees to meet the costs incurred by such an occurrence. Damage includes tears, stains, and breakage of buckles, zips, straps, buttons, tags and also smoke damage/smells. This list is not exclusive and any unreasonable damage will be charged for at the discretion of BORROW THAT BAG. Wherever possible, BORROW THAT BAG will endeavour to repair damage and keep ensuing costs as low as possible.
Bags are insured in transit from BORROW THAT BAG to the member and during their return under the conditions of Royal Mail Special Delivery.
BORROW THAT BAG undertake to despatch the bags in good condition and expect to receive the bags back in the same condition.
Replacement charges for damaged/lost or stolen handbags are determined by BORROW THAT BAG. Consideration will be given to the retail value of the handbag, its rarity, how easily replaced it is and the number of occasions it has been rented, together with its condition. If members wish to know the replacement value of any of our bags they should contact BORROW THAT BAG. We advise that members check their home contents insurance to satisfy themselves of sufficient cover should any of the above occur.

Changes to Terms and Conditions and the Website
BORROW THAT BAG reserves the right to modify and change the site and the Terms and Conditions at our discretion and without notifying members. Modifications to the website will be ongoing, to include new bags being added and obsolete bags being removed, new features and other modifications as we see fit.
If an issue arises following changes or modifications, members may exercise their right to cancel their membership of BORROW THAT BAG by contacting us directly.
BORROW THAT BAG will correct any mistakes or omissions as soon as they are discovered.
Members should check the Terms and Conditions each time they hire or more regularly.

Limitation of Liability
BORROW THAT BAG will not be held liable for direct, consequential or indirect loss or damages of any kind suffered by members as a result of any act or omission of BORROW THAT BAG. This clause extends beyond the lifespan of the membership.
BORROW THAT BAG supply only authentic designer bags, as authenticated to the best of our ability. All suppliers are rigorously checked, but BORROW THAT BAG cannot be held responsible for external companies' misrepresentation or malpractice.

Cancellation
BORROW THAT BAG may terminate the agreement, and therefore membership, at any time in the case of breach of any of the Terms and Conditions by the member or falsifying or under suspicion of falsifying details or payment records. Members may terminate the agreement, and therefore membership at any time following the return of property belonging to BORROW THAT BAG.
Members may not cancel their membership while they still have a bag in their possession, they must return the bag within 5 days or within the rental period whichever is the shorter. If the bag is not returned within this period it will be treated as lost or stolen.

Confidentiality
All emails and communication between the member and BORROW THAT BAG is confidential, unless agreed by both parties.
Members are responsible for maintaining confidentiality of their password and membership details.
If members suspect unauthorised use of their membership they must contact BORROW THAT BAG immediately and we will take appropriate action.

Acquire Function
The BORROW THAT BAG website includes the GET THAT BAG Function to allow people to buy bags, either ex-rental or brand new where available. This function is serviced by email and each case is dealt with on an individual basis.
BORROW THAT BAG cannot guarantee availability of each bag and will keep the customer advised of all communication with suppliers, any delays and all costs involved.
Delivery charges for purchased bags are £9.95 to the UK. Delivery is made by Royal Mail Special Delivery, which includes insurance under their terms and conditions.
The GET THAT BAG Function is available to members only, and BORROW THAT BAG reserves the right to offer special offers to members only as it sees fit.
The GET THAT BAG Function is currently a secondary service to the hire function and is to be considered as an additional benefit of BORROW THAT BAG.

Hire Period and Delivery/Return
The hire period begins the day the bag is shipped and ends the day it is taken to the Post Office to be returned. This is proveable by Post Office receipt and both parties must provide such proof if requested.
BORROW THAT BAG reserves the right to extend the hire period for promotional purposes, at no further cost to the member.
Customers may extend their hire period, upon the discretion of BORROW THAT BAG subject to a request being made directly to BORROW THAT BAG.
BORROW THAT BAG undertakes to email the member once the bag has been sent via Royal Mail Special Delivery. The company will not be held liable for any delays, loss or damage by Royal Mail and members agree to advise BORROW THAT BAG of any delays or damage that has occurred in transit.
When returning a bag, the member agrees to email BORROW THAT BAG to advise the bag has been despatched.
All packaging, dust bags, and authenticity cards supplied with the bag must be returned with the bag in the original protective packaging and box, which should be adequately sealed and the return label affixed.
Promotional literature may have been sent to the member within the box and may be retained by the member, disposed of or returned, as the member wishes.
Failure to return a bag on the correct date will result in BORROW THAT BAG contacting the member and treating the bag as lost or stolen. BORROW THAT BAG reserve the right to charge as detailed above.

Links, Advertising and Promotion
BORROW THAT BAG will, at times, be featured and linked to other websites and in the press. Such features and links will not always be under the control of BORROW THAT BAG and will not necessarily reflect the beliefs or opinions of BORROW THAT BAG. BORROW THAT BAG will not be held liable for such material.
BORROW THAT BAG reserves the right to use opinions or statements as it sees fit without contacting the originator first. This includes information provided on questionaires and submissions of general information.
BORROW THAT BAG undertakes to correct any inaccuracies or omissions as soon as they are detected.

Privacy and Obligations
BORROW THAT BAG takes the privacy and security of its members and website visitors very seriously.
Our full Privacy Policy is listed elsewhere on the website.
Members will not upload any information from the website that has not been created expressly for that purpose, including personal or objectionable details.
Members will not interfere with the workings of the site, its networks, servers, software or hardware.
Members will not use any of the BORROW THAT BAG logos or trademarks without the express permission of BORROW THAT BAG.
Visitors to the site will not use the site to distribute disturbing or illegal information, or transmit any information.
Use of the site is for the rental and sale of designer handbags and jewellery and gifts and for no other purpose, except notification of relevant information.
BORROW THAT BAG reserve the right to test the website at any time. Members might be included in such tests without notice.
These Terms and Conditions are governed by the laws of England and Wales. Any dispute shall be settled before the English courts.
These Terms and Conditions are not extended to third parties.

Indemnity
Members agree to indemnify BORROW THAT BAG from any loss, liability, claim or demand made by any third party due to, or arising from, use of the company's services whereby these Terms and Conditions have been breached or violated.

Copyright and Permission
No part of the website may be copied, reproduced, uploaded, transmitted or distributed without the express consent of BORROW THAT BAG.
Trademarks belonging to any company have been used in good faith and should not be altered in any way.
Use of any trademarks or trade names does not mean that BORROW THAT BAG necessarily have the express consent of the owner or any affiliation with the owner.
The opinions, information and photographs on the website are not to be held to be the opinions, or used with the consent, of the celebrities featured.

In General
BORROW THAT BAG commits to providing a designer handbag rental service, with the added option of purchasing as new or used bags where available. BORROW THAT BAG undertakes to do all that is reasonable to provide an efficient service and authentic bags to its members.
